A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, CALIFORNIA, CONVEYING CERTAIN REAL PROPERTY TO
THE REDEVELOPMENT AGENCY OF THE CITY OF SAN JACINTO
PURSUANT TO HEALTH AND SAFETY CODE SECTIONS 33334.2,33600,
33391 AND 33396
WHEREAS, the City of San Jacinto, California ('City") is the owner of that certain
real property which consists of approximately three point eight one (3.81) acres of land
located within the City of San Jacinto, California ("Property") and which is described on the
attached Exhibit A; and
WHEREAS, CRL Section 33600 of the California Community Redevelopment Law
(Health and Safety Code Section 33000 et sec .) ("CRL") permits an agency to accept
financial and other assistance from any public source for the Agency's activities, powers
and duties; and
%NMI WHEREAS, pursuant to CRL Section 33600, the City Council of the City of San
Jacinto ("City Council") desires to sell and convey the Property to the Redevelopment
Agency of the City of San Jacinto ('Agency") for the Agency to carry out its activities,
powers and duties; and
WHEREAS, pursuant to CRL Section 33396, the Agency may purchase property
and accept a conveyance of property owned by the City for redevelopment purposes; and
WHEREAS, the City and Agency have negotiated the terms and conditions of an
"Agreement for Purchase and Sale and Joint Escrow Instructions" ("Agreement") for the
sale and conveyance of the Property, further reference being had therein, and
WHEREAS, the City Council declares that the Property is surplus government
property and the inter-agency conveyance of the Property to the Agency will further the
purposes of redevelopment and be of benefit to the health, welfare, safety and morals of
the citizens of the City and will be for a public purpose; and
WHEREAS, the City and Agency have determined that the sale and conveyance
shall be for the purchase consideration of Ninety-nine thousand Dollars ($99,000.00), and
WHEREAS, pursuant to CRL Section 33391 and 33334.2, the Agency desires to

acquire the Property from the City for redevelopment purposes, more specifically, for
the purpose of developing thereon an approximately 17-unit housing project for persons of
�- low-and moderate income, as those terms are defined in California Health & Safety Code
Section 50093, and
WHEREAS, pursuant to CRL, Section 33334.2(e)(1), the Agency may spend those
monies from that certain fund Agency is required to set aside for the purposes of
increasing, providing and preserving the community's supply of low-and moderate income
housing for the acquisition of land upon which will be developed housing for persons of
low- and moderate income; and
WHEREAS. the City, as the lead agency under CEQA (as defined herein) has
determined that the conveyance of the Property is exempt from any further review under
CEQA, State CEQA Guidelines and the local CFQA Guidelines under California Public
Resources Code section 15312 because the Property is surplus government property and
California Public Resources Code section 15061(b)(3) wherein the City staff has
determined that there is no possibility that such conveyance will have a significant effect on
the environment; and
WHEREAS. pursuant to the foregoing, the City has determined that a Notice of
Exemption for the conveyance of the Property should be filed pursuant to CEQA,the State
CFQA Guidelines and the City's Local CEQA Guidelines.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San
Jacinto that:
Section 1. The City Council hereby approves the sale and conveyance of the
Property to the Agency for the purchase consideration in the amount
of Ninety-nine thousand Dollars ($99,000.00).
Section 2. The City Manager is authorized (with the concurrence of the City
Attorney) to execute and deliver the Agreement and such other
documents and instruments as maybe necessary or convenient in the
furtherance of the actions authorized by this resolution.
Section 3. The City Clerk isdirected to file a Notice of Exemption with the
Riverside County Clerk's Office within three (3) days from the
adoption of this Resolution.
Section 4, This Resolution shall take effect immediately upon its adoption.
