WHEREAS, Delta Groups Engineering filed an application on March 28, 2002, File No. CUP 3-02, for a conditional use permit to allow the establishment of a wireless telecommunication facility consisting of a 85' mono-palm ("Application") on approximately 1600 square feet of land, APN: 431-110-013, located 550 feet of Sanderson Avenue, at 770 North Sanderson Avenue ("Subject Site"); WHEREAS, the property affected by the Application is within the Controlled Development (W-2) zoning district; WHEREAS, on September 5, 2002 and October 3, 2002, the City Council of the City of San Jacinto ("Council") conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the Application was comprehensively reviewed; and WHEREAS, on June 12, 2002, the Planning Commission of the City of San Jacinto ("Commission") conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the Application was comprehensively reviewed; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JACINTO RESOLVES AS FOLLOWS: SECTION 1. Based on the entire record before the Council, all written and oral evidence presented to the Council, and the findings set forth in this Resolution, the Council grants Conditional Use Permit No. 3-02 to allow the establishment of an unmanned wireless telecommunications facility consisting of a 80' mono-palm on the Subject Site, subject to the conditions of approval in Exhibit "A" ("CUP"), Page 1 of 3 SECTION 2. Based on the entire record before the Council and all written and oral evidence presented to the Council, including the staff report, the Council finds as follows: A. The Subject Site for which the CUP is granted is in accordance with the objectives of the City of San Jacinto Development Code and the purposes of the W-2 Controlled Development zoning district because the Council has determined that use of the subject site is similar to and no more objectionable than any other conditional uses allowed within the zoning district. B. The CUP is consistent with the General Plan of the City of San Jacinto ("General Plan"), will not be detrimental to the public health, safety, or welfare, and will not be materially injurious to properties or improvements in the vicinity because: 1. The CUP provides for land uses compatible with the surrounding land use classification for the Subject Site in the General Plan Land Use Element. 2. The establishment of an unmanned wireless telecommunication facility consisting of a 80' mono-palm authorized by the CUP helps to promote and achieve the proposed location of the wireless NNW telecommunication facility is in accordance with the objectives of Zoning Ordinance 340, and the purpose of the zone in which the site is located: a. Because, the site is located in an area that has been identified in the General Plan for Public Facilities and the installation of an 80' mono-palm is consistent with the Zoning Ordinance. The proposed location of the wireless telecommunication facility and the conditions under which it will be operated or maintained will not be detrimental to the public health safety or welfare or materially injurious to properties or improvements in the vicinity. b. Because, the site is located in an area designated for Controlled Development. The proposed wireless telecommunication facility will comply with each of the applicable provisions of the San Jacinto Zoning Ordinance 340. C. Because, the site is located in an area that has been identified as an area that is unfavorable for residential or commercial development because of the existing use. An Page 2 of 3 unmanned telecommunication facility is one of the highest and best uses for the property. Nftw C. The traffic generated by the proposed conditional use will not overload the capacity of the surrounding street system and will not create a hazard to public safety because the use consists of the establishment of an unmanned wireless telecommunication facility consisting of a 85' mono-palm and only routine maintenance would be required. SECTION 3. Based on the entire record before the City Council and all written and oral evidence presented, including the staff report, the City Council finds the nature and extent of the dedications, reservations, impact fees, and other exactions are reasonably related to public needs and roughly proportional to the impacts created by use of the Subject Site. SECTION 4. The location and custodian of the documents and any other material which constitute the record of proceedings upon which the City Council based its decision is as follows: Planning Director, City of San Jacinto Planning Department, 248 E. Main Street, San Jacinto, CA 92583. (909) 487-7330. SECTION 5. Effective Date. This Resolution shall become effective upon its adoption.
