WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED determined and ordered by the City Council of the City of San Jacinto: SECTION 1. Incorporation of Recitals. The City Council hereby finds and determines that the Recitals of this Resolution are true and correct and are hereby incorporated into this Resolution as though fully set forth herein. SECTION 2. Adoption of Amendments. Section I, Item 1, Paragraph # 2 of the City of San Jacinto Land Secured Financing Policy, dated April, 2002 is hereby amended in its entirety to read as follows: 2 The use of community facilities districts or assessment districts will be permitted to finance public facilities whose useful life will be equal to or greater than the term of the bonds, including fees associated with such public facilities. Community facilities or assessment districts will also be permitted to finance the maintenance and operation of public facilities being financed by community facilities district or assessment district. Facilities that are, upon completion, owned, operated or maintained by public agencies shall be considered public facilities. Limited Page 1 of 4 exceptions will be made for facilities to be owned, operated or maintained by private utilities. However, community facilities districts or assessment districts may also be permitted to finance: (i) the costs of services to be provided by the City for the additional police protection services, including, but not limited to, criminal justice services and additional fire protection and suppression services that are necessary to meet increased demands placed upon the City as a result of development; (ii) the costs of maintenance of streets, roads and highways within the City's boundaries; and (iii) the costs of maintenance of parks, parkways and open space. a. The City is concerned that the proposed project that is to be financed is not premature for the area in which it is to be located. The proposed project must be consistent with the City's general plan. Projects that require: (i) a General Plan amendment (ii) a change of zone that increases the density or intensity of land use; (iii) a specific plan, (iv) a specific plan amendment to increase density or intensity of land use will require an evaluation by the City as to whether the proposed project is premature SECTION 3. Adoption of Amendments_ Section 11, Item 2 of the City of San Jacinto Land Secured Financing Policy, dated April, 2002 is hereby amended by adding the following immediately following the second paragraph of said section: For annexations to existing districts, a deposit in an amount not less than $11 ,500 for annexation into a community facilities district and a deposit in an amount not less than $25,900 for annexation into an assessment district shall be attached to the completed application submitted; such deposit to be determined by the Finance Director. In order to adjust for the unique circumstances surrounding the formation and subsequent annexations into the City's proposed fire and police fire protection services community service district (the "CFD") and 1892 Act road maintenance assessment district (the "1982 District"), the deposit amounts for formation of such districts and annexation into such districts shall be as follows: Petitioning Parties. For those landowners petitioning for initial inclusion (individually, a "Petitioning Party"), the Petitioning Party NOW will be required to pay the full deposit amount for the formation of Page 2 of 4 the CFD ($25,000) and, as applicable, the 1982 District ($15,000). ti.. Once the number of such Petitioning Parties who will actually joins the applicable district(s) is determined (as of the time of the final vote required by the applicant(s)), the estimated cost of joining the CFD and, as applicable, 1982 District (the "Estimated Cost of Joining the CFD" or "Estimated Cost of Joining 1982 District"), as set forth below, will be divided by that number of developers actually joining, in order to arrive at a quotient (the "Quotient"). The difference between the previously paid deposit and the Quotient will be refunded to each landowner following the last required vote on formation. The Total Estimated Cost is the sum of legal, consultant and administrative staff time and costs, and is set at $56,000 for the police and fire CFD and $51,400 for the 1982 District. Therefore, based on those figures, the calculation would be as follows: CFD Amount: Estimated Cost of Joining CFD Number of Landowners Joining 1982 District Amount: Estimated Cost of Joining 1982 District Number of Landowner Joining Non-Petitioning Parties. For those landowners who are not petitioning for inclusion in the initial formation (individually, a "Non- Petitioning Party"), the amount that must be paid will be based on the costs actually incurred by the City in excess of the Estimated Cost of Joining the CFD and, as applicable, the 1982 District, multiplied by a quotient that represents the number of lots within a particular annexing project divided by the buildout number currently within the City's development process, currently estimated to be 7,300. Based on that assumed buildout number, the calculation would be as follows, depending on which of the two districts, or both, a landowner annexes into: CFD Amount= ((Actual Costs to City of Formation of CFD — Estimated Cost of Joining CFD) X N'/7,300) + CFD Annexation Cost Estimate 1982 District Amount= ((Actual Costs to City of Formation of 1082 District - Estimated Cost of Joining 1982 District) X N17,300) + 1982 District Annexation Cost Estimate3 ' N =Number of lots within a particular annexing project. %ftw 'CFD Annexation Cost Estimate is SI 1,500. 942 District Annexatiun Estimate is$25,900. Page 3 of 4 4, In the event the actual costs to the City of annexing the project are less than the CFD Annexation Cost Estimate component or 1982 District Annexation Cost Estimate, such amount shall be refunded to the applicant following the final vote required for such annexation. SECTION 3. Remaininq Provisions. Except as specifically amended by this Resolution, all other provisions of the City of San Jacinto Land Secured Financing Policy, dated April, 2002 shall remain in full force and effect.
