NOW, THEREFORE, BE IT RESOLVED, ordered and determined by the City Council of the City of San Jacinto: SECTION 1. Based on the entire record before the City Council and all written and oral evidence presented, the City Council makes 4+ the following findings: Paget of 4 A. There are exceptional or extraordinary circumstances or conditions that do not apply generally to other adjacent properties in the same zone in that the R-1 zone adjacent properties were developed under do not have a requirement for RV parking, and the PUD overlay allows a variety of lot sizes such that over 70% of the lots in Western Village are less than 7,200 sq. ft. B. If the Zoning Ordinance is strictly applied, practical difficulties or unnecessary hardships would result depriving the applicant of rights enjoyed by other properties in the same zone by requiring the applicant to provide ten (10) foot side yards on all lots, including those smaller than the 7,200 sq, ft. required in the standard R-1 zone, which only requires five (5) foot side yards, or the option of reducing either the number of lots or the amount of open space to provide RV parking elsewhere on the property, a requirement no other zone has. C. This proposal will not result in material damage to other properties in the area nor be detrimental to the public health, safety or welfare as no other zone requires the provision of RV parking and no detrimental effects are associated or alleged with development in those zones as a result of not providing RV parking. SECTION 2. An environmental analysis has been conducted which determined that, although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because revisions in the project have been made by or agreed to by the project proponent and other effects will be mitigated to a level of less than significant impact. Therefore, a Mitigated Negative Declaration and its associated Mitigation Monitoring and Reporting Plan are hereby adopted. SECTION 3. The location and custodian of the documents and any other material which constitute the record of proceedings upon which the Planning Commission based its decision is as follows: Planning Director, City of San Jacinto Planning Department, 248 E. Main Street, San Jacinto, CA 92583. (909) 487-7330. SECTION 4. Effective Date. This Resolution shall become effective upon its adoption.
