NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN JACINTO: SECTION 1. Based on the entire record before the Planning Commission, all written and oral evidence presented, and the findings made in this Resolution, the Planning Commission of the City of San Jacinto has recommended the City Council approve the Amendment to the General Plan as set forth in the attached Exhibit "D" graphic. SECTION 2. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the Amendment promotes the goals and objectives of the General Plan and leaves the General Plan a compatible, integrated, and internally consistent statement of policies for the following reasons: A. The Amendment is integrated and compatible with the Land Use Element in that it provides an appropriate orientation and relationship between land uses within and adjacent to the Subject Site, and promotes orderly development beyond the Subject Site=s boundaries, because the residential land use is compatible with the proposed city-wide General Plan revision, and is compatible with the existing residential designation for the property to the east, whereas a residential tract (TTM 32808) have already been approved for the property to the east. B. The Amendment is integrated and compatible with the Circulation Element in that the density and distribution of uses within the Subject Site will generate traffic, which is anticipated and provided for in the Circulation Element because the site is bounded by Sanderson Avenue, an Arterial planned for six lanes of traffic. In addition, the residential tract proposed is less than what could be developed under the current designation (193 lots versus 140 lots). C. The Amendment is integrated and compatible with the Housing Element in that it provides for development consistent with the existing and projected housing needs of the community and region because the Housing Element Policy of A . . . providing a variety of housing opportunities by type, tenure, and cost to households throughout the City@ by providing for low density development in this area of the city not previously available. D. The Amendment is integrated and compatible with the Conservation Element in that the proposed residential development will promote the orderly conservation, development, and utilization of natural resources as 2 park/detention basin lots are proposed as part of the project. In addition, in-lieu park fees will be paid as part of this development. E. The Amendment is integrated and compatible with the Open Space Element in that 2 park/detention basin lots are proposed as part of the project. In addition, in-lieu park fees will be paid that is consistent with the adopted goals and policies for preserving and managing open space within the City and do not create conflicts to the realization of said goals and policies. F. The Amendment is integrated and compatible with the Noise Element in that it provides a pattern of land uses that minimizes the exposure of community residents to excessive noise, because the proposal utilizes existing streets, and provides a landscape setback along Sanderson Avenue (an Arterial planned for six lanes of traffic) to minimize ambient noise exposure from vehicles on this street. G. The Amendment is integrated and compatible with the Safety Element in that it provides an appropriate land use distribution and orientation which protects the community from unreasonable risks associated with seismic, geologic, flood, and wildfire hazards because the site is not located in a high fire hazard area, seismic zone or is subject to flooding with the improvements proposed. SECTION 3. Based on the entire record before the City Council and all written and oral evidence presented, the City Council finds the Amendment complies with CEQA for the following reasons: Although the proposed project could have had a significant effect on the environment, there will not be significant effect in this case because revisions in the project or proposals made by or agreed to by the applicant would avoid the effects to a point where clearly no significant effects would occur; therefore, A MITIGATED NEGATIVE DECLARATION has been prepared. City Staff is directed to file a Notice of Determination within 5 days of this Resolution. SECTION 4. The location and custodian of the documents and any other material which constitute the record of proceedings upon which the Planning Commission based its decision is as follows: Community Development Director, City of San Jacinto Planning Department, 248 E.
