A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, CALIFORNIA, APPROVING BOND FOR INTERIM CITY
CLERK
WHEREAS, California Government Code section 36518 provides that before entering
upon the duties of City Clerk, the City Clerk shall "execute a bond to the city", and that
the penal sum of the bond shall be "in a reasonable amount recommended by the city
attorney and fixed by the city council'; and
WHEREAS, San Jacinto Municipal Code, section 2.20.010 provides, "The city clerk of
the city shall furnish to the city a bond in the penal sum of five thousand dollars
($5,000), for the performance of his or her official duties as required by law'; and
WHEREAS, Government Code section 36520 further provides that "The city
council shall approve all bonds. When approved, the clerk's bond shall be filed with the
mayor"; and
WHEREAS, Deputy City Clerk Rick Miller was recently appointed as the Interim City
Clerk at the December 10, 2009 City Council Meeting which went into effect December
31, 2009; and
WHEREAS, as Interim City Clerk, Mr. Miller recognized his duty to obtain a bond in the
amount of$5,000.00, and on January 1 st, 2010 Mr. Miller obtained such bond to fulfill
that obligation.
NOW, THEREFORE, BE IT RESOLVED determined and ordered by the City Council of
the City of San Jacinto:
SECTION 1. The City Council of the City of San Jacinto hereby approves the
bond dated as of January 1, 2010 and presented on January 21,
2010 on behalf of Mr. Richard Miller.
SECTION 2. The City Clerk shall certify as to the adoption of this resolution. This
resolution shall be effective immediately upon adoption.
