A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, CALIFORNIA, APPROVING A CONDITIONAL USE
PERMIT TO ALLOW FOR THE CONSTRUCTION OF AN 81-UNIT
APARTMENT COMPLEX ON 4.78 ACRES LOCATED ON THE
WEST SIDE OF SANTA FE AVENUE AND SOUTH OF
ESPLANADE: CUP NO. 02-06
WHEREAS, Palm Desert Development Company filed an application on
February 28, 2006, File No. CUP 02-06, for a conditional use permit to allow the
establishment of a 81-unit apartment complex ("Application") on approximately
4.78 acres of land, APN: 439-070-022, located on the west side of Santa Fe
Avenue, south of Esplanade Avenue ("Subject Site");
WHEREAS, the property affected by the Application is within the
Residential-Multi-family (R-3) zoning district;
WHEREAS, on May 11, 2006, the Planning Commission of the City of San
Jacinto ("Commission") conducted a duly noticed public hearing on the
Application at which time all persons wishing to testify in connection with the
Application were heard and the Application was comprehensively reviewed; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution
have occurred.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN
JACINTO RESOLVES AS FOLLOWS:
SECTION 1.Based on the entire record before the Council, all written and
oral evidence presented to the Council, and the findings set forth in this
Resolution, the Council grants Conditional Use Permit No. 02-03 to allow
the construction of a 81-unit apartment complex on the Subject Site,
subject to the conditions of approval in Exhibit "A" ("CUP").
SECTION 2. Based on the entire record before the Council and all written
and oral evidence presented to the Council, including the staff report, the
Council finds as follows:
A. The Subject Site for which the CUP is granted is in
accordance with the objectives of the City of San Jacinto
Development Code and the purposes zone in which the site is
located. The site is zoned R-3 Residential-Multi-family (R-3). The
apartment complex is located in an area of existing multi-family
