A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO, CALIFORNIA, APPROVING A PURCHASE AND SALE
AGREEMENT BETWEEN THE REDEVELOPMENT AGENCY OF THE
CITY OF SAN JACINTO AND THE ASSEMBLY OF GOD CHURCH OF
SAN JACINTO
WHEREAS, the City Council ("City Council") of the City of San Jacinto ("City')
approved and adopted a redevelopment plan ("Redevelopment Plan") for a
redevelopment project area known as the San Jacinto Project Area (the "Project Area");
and
WHEREAS, the Redevelopment Agency of the City of San Jacinto ("Agency") is
engaged in activities implementing the Redevelopment Plan for the Project Area
pursuant to the provisions of Health and Safety Code Sections 33000, at seq.; and
WHEREAS, the Agency owns certain real property located within the Project
Area commonly referred to as Park Manor consisting of Assessor Parcel Numbers 437-
023-001, 437-023-002 and 437-023-005 (the "Property"); and
WHEREAS, the Agency and the Assembly of God Church of San Jacinto, a
California non-profit corporation ("Buyer'), have negotiated the terms of a proposed
purchase and sale agreement ("Agreement") pursuant to which the Agency has agreed
to sell the Property to Buyer for the fair market value of the Property and Buyer has
agreed to purchase the Property from the Agency for the fair market value of the
Property; and
WHEREAS, a copy of the Agreement is and has been on file at the Agency
office, located at 201 East Main Street, San Jacinto, California 92583, and available for
public review during normal business hours of the Agency, since October 7, 2005; and
WHEREAS, Health and Safety Code Section 33430 authorizes the Agency to
sell real property for redevelopment purposes and the Agreement is consistent with the
intent and purpose of Health and Safety Code Section 33430; and
WHEREAS, Health and Safety Code Section 33431 permits the sale of real
property by the Agency, without public bidding, following a duly noticed public hearing
regarding any such sale; and
WHERAS, the Agency published notice of a public hearing in accordance with
Health and Safety Code Section 33431 and held a public hearing on the approval of the
Agreement on the same date and immediately preceding the Agency's adoption of this
Resolution; and
