HomeMy WebLinkAboutResolution - 3029 STATE OF CALIFORNIA ) RESOLUTION NO. 3029 COUNTY OF RIVERSIDE)ss CITY OF SAN JACINTO ) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, INITIATING THE ANNEXATION OF CERTAIN REAL PROPERTY TO ASSESSMENT DISTRICT 2003-1 (AD 2003-1) PURSUANT TO THE BENEFIT ASSESSMENT ACT OF 1982 (AD 2003- 1, ANNEXATION NO. 26) WHEREAS, the City Council pursuant to Resolution No. 2485, dated November 6, 2003, formed Assessment District No. 2003-1 (the "District") pursuant to the Benefit Assessment District Act of 1982 (the "Act') for the purpose of annually levying assessments on all land within the District to pay the costs of street, road and highway maintenance within said district; and WHEREAS, the City Council has now determined that certain property that will receive the benefit of such maintenance should be annexed to the District; and WHEREAS, the territory proposed to be annexed to the District (the "Territory") is shown on a map showing thereof entitled "Proposed Boundary Map Annexation No. 26 To Assessment District No. 2003-1, City Of San Jacinto, County Of Riverside, State Of California" (the "Annexation Map"), attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED determined and ordered by the City Council of the City of San Jacinto: Section 1. Annexation. The City Council hereby proposes to annex to the District that certain real property more particularly described and shown on the map attached hereto as Exhibit "A" and incorporated by reference herein, for the purpose of annually levying assessments on all such land to pay the costs of street, road and highway maintenance as described in Section 3 hereof. Section 2. Boundaries and Designation. The property to be included within the proposed boundaries of Annexation No. 26 is described and shown on the map attached hereto as Exhibit "A" and incorporated by reference herein (the "Annexation Area"). Section 3. Road Maintenance. The services proposed to be financed through the revenue derived from the assessments is to include maintenance of those streets, roads, or highways within the Annexation Area. Section 4. Report. The City Engineer is ordered to prepare or cause to be prepared and filed with the City Clerk a report regarding the Page 1 of 3 proposed Annexation No. 26 and the assessments to be levied on the land therein to pay the estimated annual costs of the street, road and highway maintenance described in Section 3 hereof in the fiscal year 2006-07 in accordance with Government Code section 54703 et se ., Government Code section 53753, and Article XIIID of the Constitution of the State of California. Said report shall contain all of the following: (a) A description of the service proposed to be financed through the revenue derived from the assessment to the property located within the Annexation Area. (b) A description of each lot or parcel of property with the Annexation Area that is subject to the benefit assessment. The assessor's parcel number shall be a sufficient description of the parcel. (c) The amount of the proposed assessment for each parcel within the Annexation Area. In the case of an assessment to be collected in installments pursuant to paragraph (2) of subdivision (a) of Government Code section 54711, the report shall set forth the number of annual installments and the fiscal years during which they are to be collected, and fix the maximum amount of each annual installment. (d) The basis and schedule of the assessment within the Annexation Area.
