JACINTO, CALIFORNIA, AUTHORIZING THE CITY ENGINEER TO
ENTER INTO A CONTRACT FOR THE INSTALLATION OF CERTAIN
STORMWATER PROTECTION IMPROVEMENTS
WHEREAS, the City of San Jacinto ("City") is charged with protecting the health,
safety and welfare of the residents within the City; and
WHEREAS, very recent wildfires within the mountains above Soboba Drive have
reduced the ability of those slopes to adequately absorb and/or retain stormwater; and
WHEREAS, those mountains and the general vicinity include steep slopes that
require emergency stormwater protection efforts in order to stabilize and secure
boulders, rocks, soil and debris in imminent danger of sliding from the slope onto
adjacent properties, thus posing a current threat to the lives and properties of those
along and within the vicinity of Soboba Drive; and
WHEREAS, as a result of the inability of those slopes to absorb and/or retain
stormwater, a very real and immediate threat to the lives and properties of those along
Soboba Drive exists; and
WHEREAS, it is critically important to complete certain stormwater protection
efforts consisting of a mud interceptor along Soboba Drive as soon as possible, and
certainly before the winter weather makes such work impossible and infeasible, in order
to protect life, health and property; and
WHEREAS, time does not permit the preparation of specifications and the
solicitation of competitive bids before commencement of the emergency Stormwater
protection efforts; and
WHEREAS, San Jacinto Municipal Code section 3.08.130(A) authorizes the City
to perform public works without competitive bidding in the case of emergencies; and
WHEREAS, based on the foregoing as well as the staff report and testimony
presented at the City Council meeting at which this Resolution is adopted, the City
Council hereby finds that the emergency created by the recent wildfires and upcoming
winter season will not permit a delay resulting from a competitive solicitation for bids,
and that this action is necessary to respond to the emergency created by the recent
wildfires and upcoming winter season.
