A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO APPROVING CONDITIONAL USE PERMIT NO. 4-06 FOR
THE ESTABLISHMENT OF AN UNMANNED WIRELESS
TELECOMMUNICATIONS FACILITY CONSISTING OF A 45' MONO-
ELM ON PROPERTY LOCATED AT 1531 MOUNTAIN AVENUE: CUP
NO. 04-06.
WHEREAS, Cingular Wireless filed an application on July 19, 2006, File No. CUP
04-06, for a Conditional Use Permit to allow the establishment of a wireless
telecommunication facility consisting of a 45' mono-elm (Application) on approximately
1,200 square feet of land at 1531 Mountain Avenue, (Subject Site); and
WHEREAS, the property affected by the Application is within the Neighborhood
Commercial (C-1) zoning district; and
WHEREAS, the Application was reviewed, studied, and found to comply with the
California Environmental Quality Act (CEQA) as more fully described below; and
WHEREAS, on May 17, 2007, the City Council of the City of San Jacinto ("City
Council") conducted a duly noticed public hearing on the Application at which time all
persons wishing to testify in connection with the Application were heard and the Application
was comprehensively reviewed; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution have
occurred.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JACINTO
RESOLVES AS FOLLOWS:
SECTION 1. Based on the entire record before the City Council, all written and oral
evidence presented to the City Council, and the findings set forth in this Resolution, the
City Council grants Conditional Use Permit No. 04-06 to allow the establishment of an
unmanned wireless telecommunications facility consisting of a 45' mono-elm on the
Subject Site, subject to the attached conditions of approval in the staff report.
SECTION 2. Based on the entire record before the City Council and all written and
oral evidence presented to the City Council, including the staff report,the City Council finds
as follows:
