A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO CONCERNING THE ISSUANCE OF BUILDING PERMITS
PENDING ADEQUATE ASSURANCE REGARDING SEWER
AVAILABILITY
WHEREAS, the City of San Jacinto ("City") is authorized by California
Constitution, Article IX, Section 7 to make and enforce within its limits all local, police,
sanitary, and other ordinances and regulations not in conflict with general laws; and
WHEREAS, among the most basic and fundamental governmental functions of
local government is the provision of the adequate provision of sanitation services,
including sewer services; and
WHEREAS, the rapid rate of private development within the City has, on
occasion, recently surpassed the rate of provision of sewer facilities, specifically
regional sewer facilities that are to be provided by Eastern Municipal Water District
("EMWD"); and
WHEREAS, the City Council has, in the recent past, been faced with requests by
residential developers seeking occupancy of dwellings prior to the completion of
regional sewer facilities, thus necessitating the temporary storage and vehicular
transportation of sewage; and
WHEREAS, the City Council has determined that the failure to assure the timely
provision of sewer services, specifically the installation of regional sewer facilities by or
on behalf of EMWD, will result in the residents of the development and residents of the
immediate community being placed in a condition perilous to their health and safety
because of the need for storage and vehicular transportation of sewage; and
NOW, THEREFORE, BE IT RESOLVED, determined and ordered by the City
Council of the City of San Jacinto as follows:
Section 1. The City Council hereby adopts the recitals of this Resolution as
true and correct and such recitals are hereby incorporated by
reference as though fully set forth in the text of this Resolution.
Section 2. City staff shall identify those developments that require construction
of EMWD master planned sewer facilities for sewer service.
Section 3. As a condition to the issuance of any building permit for any new
development, the City shall receive from EMWD, written
confirmation that any and all master planned sewer facilities that
are identified as necessary for that development are within ninety
(90) days of substantial completion.
