RESOLUTION NO. 3098
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JACINTO, CALIFORNIA, DELEGATING
AUTHORITY FOR THE ACCEPTANCE OF PUBLIC
WORKS AND NOTICES OF COMPLETION TO CITY
ENGINEER AND CITY MANAGER
WHEREAS, pursuant to Public Contract Code Section 7107, a City of San
Jacinto public work is complete when, among other things, the work of public
improvement is accepted by the City; and
WHEREAS, pursuant to Civil Code Section 3093, a "Notice of Completion" may
be recorded in the office of county recorder of the county in which the project site is
located, within 10 days after such completion; and
WHEREAS, pursuant to Civil Code Section 3184(a), a contractor of a public work
must serve any stop notice on the agency before expiration of 30 days after the
recording of said Notice of Completion; and
WHEREAS, pursuant to Civil Code Section 3184(b), if a Notice of Completion is
not filed within the required time period, then the contractor must serve any stop notice
on the City before expiration of 90 days after completion of the work; and
WHEREAS, the City Council desires to streamline the process and to shorten the
time within which contractors can file stop notices and thereby shorten the time for the
release of retained funds; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San
Jacinto as follows:
SECTION 1. The City Council hereby delegates to the City Engineer, the right,
but not the obligation, to accept public works as complete upon the verification of the
City Manager.
SECTION 2. The City Council authorizes the City Clerk to file with the County
Recorder a Notice of Completion, verified by the City Clerk, upon the submission by the
City Manager of a document accepting the public work as complete.
