RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO ORDERING THE RECORDATION OF A NOTICE OF
CESSATION OF SPECIAL TAXES FOR ANNEXATION NO. 27 OF
COMMUNITY FACILITIES DISTRICT NO. 2003-1 OF THE CITY OF SAN
JACINTO
WHEREAS, the City Council of the City of San Jacinto (the "City Council'),
previously formed a Community Facilities District to finance certain police and fire
services pursuant to the provisions of the "Mello-Roos Community Facilities Act of
1982," being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the
State of California, said Article 3.5 thereof. The existing Community Facilities District
being designated as COMMUNITY FACILITIES DISTRICT NO. 2003-1 ("CFD No.
2003-1"); and
WHEREAS, the City Council has also established a procedure to allow and
provide for future annexations to CFD No. 2003-1 and the territory proposed to be so
annexed in the future was designated COMMUNITY FACILITIES DISTRICT NO. 2003-
�. 1, FUTURE ANNEXATION AREA; and
WHEREAS, on March 2, 2006 pursuant to the future annexation proceedings,
Tract No. 24419 was annexed into CFD 2003-1 as Annexation No. 27; and
WHEREAS, following such annexation it was discovered that pursuant to the
conditions of development for Tract No. 24419, Tract No. 24419 was not required to be
annexed into CFD 2003-1; and
WHEREAS, in order to rectify the mistaken annexation of the property to CFD
2003-1, the City now desires to remove the lien created by CFD 2003-1 by ordering the
recordation of a notate of cessation on the property.
NOW, THEREFORE, BE IT RESOLVED, that by the City Council of the City of
San Jacinto as follows:
SECTION 1. The recitals stated above are true and correct and
incorporated herein by this reference.
SECTION 2. The City Council hereby orders the Finance Director to
cause the recordation of the Notice of Cessation presented
in Exhibit "A," which is attached hereto and incorporated
herein by this reference.
