February 2022) March 15, 2022 TO: City Council REQUESTED BY: Tom Prill, Deputy City Manager APPROVED BY: Robert A. Johnson, City Manager SUBJECT: Resolution No. 3910 – Amending San Jacinto Power Electric Generation Rates RECOMMENDATION: Staff recommends that the City Council: 1) Adopt Resolution No. 3910 amending San Jacinto Power electric generation rates effective March 1, 2022. BACKGROUND: San Jacinto Power (“SJP”) has been serving customers since 2018. An essential part of SJP’s operation is rate setting. A fundamental requirement in setting rates is to ensure sufficient revenue to cover SJP’s operating expenses and provide for reserves. For ease in customer understanding and cost comparisons, SJP’s rates are developed to mirror those of Southern California Edison (“SCE”). SJP sets its rates to offer customers competitive rates and to cover the expenses related to power procurement and administration. SJP rates have remained competitive and have not changed since June 2021. The proposed rate adjustment considers SCE’s final 2022 generation rates and exit fees effective March 1, 2022. This year, SCE is in a difficult situation as they set generation rates for the coming year based on their performance in the prior year. Because of energy market volatilit y, customer power generation rates are seeing dramatic price increases. SCE’s generation rates are anticipated to increase by 23 percent, as over the past year SCE under collected from its customers by nearly $800 million. The proposed rate schedule adjusts SJP rates to provide savings in generation costs compared to SCE, resulting in an overall 1.5% savings on generation for SJP customers. By reviewing and adjusting rates along with SCE activities, SJP can ensure customer savings is achieved while also ensuring rates reflect the current power market to cover costs and maintain healthy reserves. FISCAL IMPACT: The rates as proposed generate sufficient revenues to cover the costs of the program. 4.1 Packet Pg. 49 ATTACHMENTS: Reso 3910 - SJP Generation Rates - 03-15-22 SJP 2022 Rates - Proposed Effective 03-01-22 - combined 4.1 Packet Pg. 50 STATE OF CALIFORNIA ) RESOLUTION NO. 3910 COUNTY OF RIVERSIDE ) ss CITY OF SAN JACINTO ) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO AMENDING ELECTRIC GENERATION RATE SCHEDULE FOR SAN JACINTO POWER COMMUNITY AGGREGATION PROGRAM WHEREAS, the City of San Jacinto (“City”) is a municipal corporation organized and operating under the laws of the State of California with the City Council of the City of San Jacinto (“City Council”) acting as the governing body of the City; WHEREAS, the City Council of the City of San Jacinto has heretofore adopted Ordinance 16-12, declaring its intent to establish a Community Choice Aggregation (CCA) program to be known as San Jacinto Power (SJP); WHEREAS, the City Council has additionally heretofore approved an Implementation Plan to establish a CCA program, and such Implementation Plan was certified by the California Public Utilities Commission on April 6, 2017; WHEREAS, the City Council has previously established electric generation rates for San Jacinto Power; and WHEREAS, the City Council wishes to amend the rate schedule; and WHEREAS, the rates as proposed are sufficient to cover the operating costs of SJP, including maintaining reserves; and WHEREAS, the City Council has held a duly noticed public hearing and has considered all evidence and testimony offered at said hearing. Johnson, City Manager SUBJECT: Robert Luntz Appeal P22-001 RECOMMENDATION: Staff recommends that the City Council DENY the appeal and UPHOLD Staff’s decision to require the applicant to connect to the Lake Hemet Municipal Water District (LHMWD) sewer system. DISCUSSION: On November 29, 2021, the City received a building permit application to replace an existing septic tank for a single-family home located at 788 East Washington Avenue. The building permit application was reviewed and denied by the Planning Division on December 20, 2021. On January 3, 2022, the City received an application to appeal Staff’s decision to the City Council. The subject site is located on a 0.15-acre parcel that is located on the south side of East Washington Avenue and directly north of Park Avenue. The subject site consists of a 1,486 square foot single-family home that was built in 1946. The property owner had recently placed the home for sale, which resulted in the need for the existing septic tank to be certified. The septic system failed the certification test. ANALYSIS: The City’s Municipal Code Section 13.20.020 states that “No person shall install, replace or cause to be installed, replaced or repaired any septic tank, cesspool or leach line in the City on property adjacent to or within two hundred feet (200) of an existing sewer line without having first secured a permit from the superintendent [City Manager] authorizing the replacement, repair or installation. A permit shall be issued only in the event that denial thereof would create an undue hardship...” City Staff reached out to Lake Hemet Municipal Water District (LHMWD) to confirm that a sewer main exists adjacent to the site within Park Avenue and to determine if any potential issues exist that would prevent connection from the house to the sewer main (flow, gravity issues, capacity, etc.). Staff from LHMWD verified that the sewer main is located within Park Avenue and is approximately 25-feet from the property line and 55-feet from the dwelling unit. The response from LHMWD also clarified that the 10” sewer line is approximately 6-feet north of the centerline at an approximate depth of 13-feet and that a residential lateral was feasible at the location. The applicant was informed of this information and has obtained estimates of the costs for both the sewer connection and septic tank replacement. The table below shows the proposals for both the septic tank replacement and sewer connection. Table 1 – Estimates for Sewer Connection and Septic Tank Replacement 4.2 Packet Pg. 66 Proposal Estimate Proposal 1 – Septic System Replacement with Certification Minimum $25,000 – Maximum $31,500 Proposal 2 – Septic System Abandonment, Connection to City Sewer, Fees Minimum $50,050 – Maximum $59,711 The proposals shown in Table 1, include connection fees for LHMWD ($2,630) and Eastern Municipal Water District (EMWD) ($9,661). LHMWD is the entity that would collect the wastewater through the existing sewer lines. Transmission and treatment services are provided by EMWD. However, since County database shows that the home was built in 1946 and because it is located in an existing EMWD improvement district, the property may be exempt from the sewer capacity fee per EMWD’s Administration Code. Before a determination of this exemption can be made, the applicant would be required to provide proof of construction in forms of permits or other city/county documentation. Such determination is made by EMWD, not the City. Septic systems are considered one of the most significant sources of nitrates that affect ground water resources. When septic systems are properly designed they can treat domestic wastewater to reduce the polluting impact on ground water and most importantly protect public health. However even properly functioning septic systems increase nitrate levels within the soil and, consequently, ground water sources, and therefore new residential developments are typically not allowed to be developed without a sewer connection if the lots will be less than 0.5 acres or more than 2 units per acre. The minimum lot size limits the density, thereby reducing the concentration within a specific area. Septic systems typically have a lifespan of 20-30 years, if properly maintained. Once a septic system fails nitrate levels may begin to increase further affecting water quality levels. If constructed today, the property would not be permitted to utilize a septic system and would be required to connect to the local sewer system. The connection of this existing residence to the LHMWD sewer does not require any special circumstances that would constitute an undue hardship. The existing sewer line in Park Avenue allows for connection with a relatively short lateral and without any significant constraints. While the requirement to connect to sewer may be a financial hardship to the property owner, it would not be an undue hardship as the standard would be applied universally throughout the City. There are no unique or special circumstances specific to this property that would preclude connection to the sewer system or substantially increase the cost to connect. As such, staff denied the permit request to replace the septic system. Per Section 13.20.030 of the Municipal Code the applicant has appealed staff decision and requested the City Council (1) allow the replacement septic system or (2) to cover the cost of the sewer project as the connection requirement is a financial hardship. The applicant has also requested to be reimbursed for the cost of the appeal ($1,200.00). Connection to a sewer system improves the environment and public health, by protecting drinking and surface water with the reduction of nitrates within the water supply. Therefore, staff does not recommend allowing the replacement of the septic system in this instance. Furthermore, the connection of the subject residence to the LHMWD sewer system is not considered an undue hardship. 4.2 Packet Pg. 67 An undue hardship may occur for property owners that have a residence that is located within 200 feet of a sewer system, but face significant challenges to connect a residence to a sewer system. As an example, if the only sewer line was located at a grade higher than the residence, an undue hardship may be established because a sewer lift station would need to be installed. In addition to the added installation cost, it would create a significant ongoing maintenance obligation. Further, the installation of a sewer lift station is typically a public improvement, rather than a private improvement, which then creates a burden on the public agency to maintain such a device. A second example is a residence that is less than 200 feet from a sewer line, however the connection would require the owner to acquire land or an easement from one or more property owners to make the connection. Requiring the acquisition of land from adjacent owners would constitute an undue hardship. However, as noted above, the site does not have these restrictions and therefore, there is no undue hardship in requiring the sewer connection. Based on the preceding, staff recommends that the City Council deny the appeal and uphold staff’s decision to require the connection with full cost of the sewer connection paid for by the property owner/applicant. However, in the event the City Council elects to approve the appeal (in part or in whole) and overturn the staff determination, the City Council may want to consider one of the following alternatives: 1. Approve the appeal and allow the applicant to replace the existing septic system, paid entirely by the applicant. 2. Deny the appeal, but approve a contribution of funds to reduce the financial hardship imposed by the requirement to connect to the sewer system. Funds would need to be appropriated from the Sewer Capital Improvements Fund (Fund #053, a rate payer fund) and will be used to off-set a specific amount (as determined by the City Council) paid to LHMWD. City contribution of funds to the project will likely result in higher construction costs as the project may be subject to prevailing wage. FISCAL IMPACT: As recommended by staff, there are no fiscal impacts associated with this item as all project costs are borne by the applicant. In the event the City elects to contribute funds, or reimburse the appeal fee, such funds would need to be appropriated from the Sewer Capital Improvements Fund #053. I am experiencing many age related physical problems and am having difficulty maintaining the home that I am now in. My home is fairly large and I live alone. Everything was going fine with the sale until the septic certification test. Even thought my Septic System works fine, it failed to certify. I was told that I could not repair or replace the septic because I was within 200 feet of a sewer line. I checked with EMWD (Traci Sigwalt) and was told that there was no Sewer line on Washington Ave. between Arroyo Viejo and Hewitt, but that there was one on Park Ave, which is on the other side of my house and it belongs to LHMWD. After a few messages back and forth with LHMWD, it was determined that I could connect there at a cost of $59,711. $35,790 for all work on a lateral in street and street repair. $11,630,000 for on property work $2,630 to LHMWD for Fees and Inspection $9661.00 for fees per EMWD (see attached bids) I have been informed that I live in an improvement zone and can get EMWD fees waved. That still leaves a cost of $50,050 which would be a severe hardship for me to pay since I live on SS and a small pension. I got an estimate of $25,000 to replace the septic system, which is approximately ½ the cost of a Sewer connection. I have already lost buyers due to the high cost of Sewer connection. I cannot afford the cost of Sewer connection. I cannot sell my house for a high-enough price to recoup these Sewer hook-up costs, and still be able to purchase another home. I ask to be reimbursed for the $1200 fee for cost of this Appeal. Susan Beeson from the State Water Board suggested that I might be able to get a Variance from the City Council to go ahead with a Septic replacement. With farm animals a few houses to the West of me and many animals about ¼ mile to the East of me, I fail to understand why my Septic System could possibly pollute our water as much as the animals. Therefore, I am asking you to please give me a VARIANCE for a new Septic System. If this cannot be done, I ask for you to cover all costs of the SEWER project. Please see all attachments. Thank you.
