Therefore, residential rate in San Jacinto sewer and water service area will be $16.85. BACKGROUND: The City of San Jacinto and EMWD signed a 40 year Interagency Sewage Agreement in 1965. As part of the agreement, the City is required to remit a fee based on the active sewer connections multiplied by the applicable collection rate to EMWD for the purpose of maintaining and operating their sewer facilities. The City of San Jacinto maintains collection lines in its service area and EMWD maintains a system of trunk sewers and treatment facilities. All sewage and waste collected by City collection lines are transmitted to EMWD for treatment and disposal. The City of San Jacinto charges a monthly sewer rental fee along with water service in our water service area. The sewer rate is made up of two components in the City of San Jacinto service area (the second component is not collected outside of the City of San Jacinto service area): 1) EMWD sewer transmission, treatment and disposal facilities maintenance fee — (per Interagency Agreement), Approv . City Manager: Finance Director: I Page 2 Sewer Rate Increase • 2) City of San Jacinto sewer rental fee (M.C. 13.24.030, et. seq.) Resolution 2074, 10/20/92 imposes a fee of $3.50 for each residential unit and a sliding scale for commercial and industrial users. The EMWD sewer fee for single family residences will be at a new base charge of $13.35. The multiple residential, commercial and other will be charged in accordance with the sewer rate schedule and EDU's. The EMWD daily rate has gone up approximately 22%. Therefore, a single family residence in the San Jacinto service area will be charged $13.35 + $3.50 for a total of $16.85 per month. EMWD has reevaluated costs to include COP debt, ID-H program costs as well as capital replacement program costs. Residential Rate Component Old Rate New Rate Increase ok SJ Line $3.50 $3.50 $0.00 0% Maintenance EMWD Charge $10.92 $13.35 $2.43 22.2% Total Base Rate $14.42 $16.85 $2.43 16.8% • The last increase by EMWD was two years ago in which the base transmission rate was changed from $9.90 to $10.92. JUSTIFICATION: EMWD board adopted Resolution 3352.7, dated January 1, 2004, which increased the sewer rate for transmission, treatment and disposal of sewage. The City is required, by terms of the Interagency Agreement between EMWD and the City of Jacinto, to remit a higher fee based on Resolution 3352.7. In accordance with H & S §5471 , an ordinance is required to raise sewer user fees. At a minimum, an ordinance generally takes approximately 75 days, including publishing requirements, before it becomes effective. The City was officially notified on December 23, 2003 that the new EMWD rate will take effect on February 1st 2004. Therefore, an urgency ordinance is necessary to ensure that the City can meet its obligations under the Interagency Agreement and to assure that no service interruptions occur. An urgency ordinance must be adopted by 4/5 vote of the City Council. BUDGETARY IMPACT: • 2 4110 Page 3 Sewer Rate Increase There is no budgetary impact. The increased sewer fee revenue authorized by this Ordinance will offset the increased sewer maintenance fee payable to EMWD. Thus, it meets the requirements of California Government Code, Section 66000 et seq. Therefore, the City Council finds, with respect to the revenue derived from the increased fees and charges, that (1) there is a reasonable relationship between the use of the fees and charges increased herein and the services for which they are imposed; (2) the revenue derived from the increased fees and charges does not exceed the amount necessary to provide the services; (3) the increased fees and charges shall not be used for any other purpose than that for which the fees and charges are imposed; (4) the increased fees and charges do not exceed the proportional cost of the services attributable to each customer; (5) the increased fees and charges are not levied for general governmental purposes; • WHEREAS, California Government Code Section 36937 empowers cities to adopt, by four-fifths vote, and urgency ordinance, which is necessary for • the immediate preservation of the public peace, health or safety. The increased fee shall be effective on February 1, 2004 and shall be applied to any billing on or after February 1, 2004. SECTION 3. Rathbone, Jr. General Manager Director of Finance Directors: All Divisions: All • --- .._.... — . Board of Directors December 17, 2003 Page 2 BACKGROUND On December 19, 2001, the Board approved the last set of daily sewer service charge rate increases that were applied to all but the Temecula Service Areas. The overall average was approximately $.010/day with a maximum of$.034/day in the Hemet/San Jacinto Service Area. These rates were effective January 1, 2002 and have remained the same for two years. In August of this year, a team was developed to review the current methodology and rates being applied to the various service areas. The intent was to evaluate the relationship between wastewater and recycled water as well as ensure that proper funding was being provided for debt service and replacement projects. Currently, there are no provisions in the rates for these cost elements. The evaluation resulted in the following recommendations: 1) Include a component cost to satisfy the COP bond covenant requiring that the District maintain a minimum of 90 days in reserve to meet operating expenses (this component was also added to the water rates in May of this year). • 2) Provide funds to support the capital improvement program - specifically those projects related to replacement and system betterment. This would also reduce reliance on property taxes that are the sole source of revenue for these projects. 3) Provide funds to replace capital equipment used at the facilities (not construction). 4) Contribute to the annual payment of debt service related to the recycled program that cannot be paid from connection fees. This will assure a reliable source of revenue that does not exist currently. Currently, all payments are funded from connection fees. 5) Contribute to ID-H operating fund, $.50/mo/connection, to pay for any disposal costs that would be incurred by ID-H. Any funds not needed would be used to pay for infrastructure to promote/improve delivery of the recycled water to expand the program. These recommendations were presented to the Board Administrative Committee and were approved. However, it was recommended that a phased in approach be utilized to reach the recommended rates. Therefore, the proposal is to implement over a two-year period. This is illustrated in the attached Exhibit A along with some supporting documentations for the first year proposal. The increases vary from $.029/day in Temecula to $.080/day in Hemet/San Jacinto. On average, the increase is $.051/day. The estimate of the second year increase ranges from $.018/day in Moreno Valley to $.079/day in Temecula. On average, the increase is $.046/day. However, the second year proposal will be evaluated prior to implementation to ensure that the objectives are IDbeing satisfied and assumptions used are substantiated. • Board of Directors December 17, 2003 • Page 3 These rates will be effective January 1, 2004 and be reflected in the customer's billings beginning February 1, 2004.
